NIVONA Apparate GmbH, Südwestpark 49, 90449 Nürnberg, Germany (hereinafter: NIVONA) grants to the end user a manufacturer's guarantee for this appliance under the terms described below; the statutory rights for defects that you are entitled to towards the seller for a minimum period of two years starting with the delivery of the purchased item shall not be restricted by the guarantee granted below.

  1. NIVONA guarantees that this newly manufactured appliance, designed and constructed for the preparation of coffee and hot beverages, in quantities suitable for an average household, at the time when sold by the dealer to the end user shows the qualities listed in the product description for this appliance and is free of any defects according to construction, material or manufacturing. Defects entitling to the assertion of guarantee claims exist subject to the value or the usability of the appliance being considerably reduced, exclusively.
  2. This guarantee applies provided that the appliance was bought in a member state of the European Union [EU] at a specialised dealer authorised by NIVONA and provided that it is operated within the EU at the time the defect appears.
  3. The guarantee period extends to 24 months starting with the day of sale by the dealer to the first end user.
  4. A guarantee claim has to be asserted towards the Central Service Office of NIVONA in charge of your country within the guarantee period by letter, e-mail or phone. The adresses and contact data of the relevant Central Service Office are listed at the end of the present Terms of Guarantee as well as - as effective at a time - on the internet at www.nivona.com. For first information you may also turn to an authorised NIVONA dealer.
  5. In case of a guarantee claim the end user has to send the appliance to the appropriate Service Office properly packed (original packaging, if possible) and supplied with the complete address of the end user together with a short description of the defect. To prove the guarantee claim the original purchase proof (sales slip, invoice) has to be added showing the name and address of the dealer, date of purchase and type of appliance.

  6. NIVONA will furnish guarantee by - at its discretion - either repairing the appliance or exchanging defective parts or exchanging the complete appliance. Exchanged parts or appliances become the property of NIVONA.

In case that at the time of the event making the guarantee operative the appliance is no longer manufactured by NIVONA, NIVONA will deliver an appliance of its choice of at least the same quality from the current production.

Guarantee services shall neither imply an extension nor a restart of the guarantee period for the respective appliance. NIVONA will bear the costs for returning the appliance to the end user only to the extent necessary to send the appliance from the nearest Service Office to the end user. Any exceeding expenses are payable by the end user.

  1. Exempted from the guarantee are
    a) exhibits and demonstration appliances,
    b) appliances operated for the preparation of coffee and hot beverages in gastronomy or hotel business,
    c) defects arisen by installing, operating or maintaining the appliance contrary to the instructions of use,
    d) defects arisen by fall, excess voltage or impacts from outside or interference by persons not authorised by NIVONA,
    e) defects at parts subject to wear (e.g. sealings, valves) or defects arisen due to defects at parts subject to wear as well as damages arisen by foreign particles in the grinder (e.g. stones);
    f) appliances not purchased at a specialised dealer authorised by NIVONA,
    g) exchange of expendable material (e.g filter) as well as cleaning or maintaining works unless they are necessary for repairing the appliance.
  2. Any claims of the end user other than the rights of repair, of exchange of defective parts or exchange of the defective appliance provided for in these Terms of Guarantee shall not be justified under reference to the present guarantee.
